(1) This Recruitment Agreement signed
between (Employer) hereafter referred
to as the second party (Recruiter) and
hereby agrees the terms and conditions
mentioned below for the recruitment
of Nepalese workers to Kingdom of Saudi
Arabia for the Employer’s on going
requirements as and when the Employer
presents a Demand Letter, Power of Attorney
and an original Visa Slip
(2) The first party hereby confirms
that they have appointed the Second
Party to be their legal agent in Nepal
for the recruitment of Nepalese workers
to their Company in Kingdom of Saudi
Arabia, for their on going requirements.
(3) The Second Party hereby agrees
to take all responsibility under the
law of His Majesty’s Government
of Nepal and to recruit and deploy Nepalese
workers as per the Demand Letter of
the First party on the terms and conditions
set forth on their Demand Letter and
Power of Attorney.
(4) The Second Party is responsible
to recruit qualified workers as per
the First Party’s request and
instructions; the Second Party is responsible
if the recruited worker does not complete
his 90 days probationary period. If
the recruited worker leaves the country
on an exit visa within 90 days due to
violation of rules and regulations,
being medically unfit, or any other
reason, the Second Party will reimburse
the First Party all costs associated
with repatriation, visas, etc.
(5) The First Party is responsible
to provide its’ employees, suitable
shared housing, medical, transportation
from residence to and from the place
of work and pay the salary on time.
(6) The first party
shall issue a Demand Letter to the Second
Party mentioning the number of workers
requirement, rate of their salary and
other service.
(7) Both parties herein
shall obtain the approval of the respective
government to import, recruit and supply
the workers as per rules of both countries
in regard to the conditions necessary
to import and supply. In case of any
conflict between government rule and
the conditions of this contract, this
deed of agreement shall be deemed as
Null and void.
(8) The First Party
shall provide with Visa of the workers
from the government authority, together
with other necessary relevant documents.
In case of not issue of Visa due to
any changes in Government policies,
the first party shall be responsible
for the recruitment experience.
(9) The First Party
will be responsible for receiving the
workers at the airport in part and as
whole as per validity of Visa of the
concerned country.
(10) The second party
is the supplier of the workers and will
bear the responsibility for recruitment
of the workers from Nepal exactly as
per trade or may invite the first party
or his authorized representative for
recruitment of the workers within the
stipulated period and not exceeding
30 days from the receipt of visa advice
and other allied required documents.
(11) The First Party
agrees to bear the compensation in case
of death or injury of the workers and
also agrees to bear the cost of transport
of dead body to Nepal as per the labours
law of country concerned.
(12) There will three
months probationary period for all workers;
after completion of this period, if
any worker is found unfit or unsuitable
for the specific job, the worker may
be terminated and repatriated at his
own cost and the cost will be borne
by the Second Party.
(13) The Second Party
shall assist the workers in matters
relating to immigration formalities,
medical test and Visa stamping from
the relevant Embassy and whatever other
relevant matters.
(14) The First Party
agrees to enter into agreement with
Second Party to supply Nepalese manpower
of different categories such as skilled,
semiskilled and unskilled workers, the
numbers and qualification in respect
there are be specified by the first
party through task orders.
(15) The Second Party
shall be responsible for short of qualified
candidates in conformity with the first
party’s requirements. The second
party notifies the first party of such
short listed qualified candidates who
are ready for final interview and selection.
The first party has the right to either
send his representatives or give the
second party the right to select candidates,
process and send such qualified candidates.
